COUNTY
GOVERNMENT STRUCTURE
Dare
County has a county commission-county manager system of government. A seven member Board of Commissioners sets policy and a
county manager, appointed by the Commission, executes policy directives.
Commissioners are elected to four year terms, some
of which expire each even-numbered year. All Commissioners except one at-large seat must reside in a specific district.
Each Commissioner is elected in a county-wide election. The Board elects a
chairperson and vice-chair for a one year term at
its organizational meeting in December. |
The
Board has countywide responsibility for educational funding, libraries, Parks
and Recreation, Emergency Medical Services, and tax assessment. The Board is
the sole governing body for the unincorporated areas of Dare County including
Colington, Martin’s Point, Manns Harbor, Stumpy Point,
East Lake, Wanchese, northern Roanoke Island, and all of Hatteras Island. In
these areas, the County is responsible for planning and zoning, solid waste
management and law enforcement. |

The Office of the Clerk of
Superior Court is responsible for all administrative, clerical and
record-keeping functions of the District and Superior Courts. With the exception of juvenile files, adoption records and
certain other confidential records, files in the Clerk’s office are public
records and available for inspection to the public. The Clerk serves as
Comptroller and Judge of Probate, with exclusive original jurisdiction over
matters regarding the probate of wills and administration of estates in his
county. The Clerk also presides over many other legal matters such as
adoptions, incompetency and guardianship proceedings, partitioning of real property, name changes,
real estate foreclosures, and petitions for surplus funds. | ||
NORTH
CAROLINA COURT SYSTEM
The North Carolina court
system consists of an Appellate Division, a Superior Court Division, and a
District Court Division. A chief justice and six associate judges, elected for 8-year
terms, serve on the Supreme Court. The Court of Appeals is served by a chief
justice and 14 associate justices elected for 8-year terms.
Dare County is served by
two Superior Court judges and five District Court judges. Superior Court judges
rotate throughout the state, and District Court judges rotate throughout their
division and district. Dare County is in the 1st judicial district of the 1st
division, which has seven counties. Only
persons qualified to practice law in North Carolina are eligible for election
or appointment to any of these courts.

Bureau promotes the county’s major industry: tourism. The Bureau is governed

TOWNS
The
incorporated towns of Duck, Kill Devil Hills, Kitty Hawk, Manteo, Nags Head and
Southern Shores have their own municipal governments. Each is governed by a
town council or board of commissioners. Mayors in Kill Devil Hills, Kitty Hawk,
Manteo, Nags Head and Southern Shores are elected by the voters; in Duck the
mayor is elected by the town council from among its members. All municipalities
have a town manager. Each town provides for its own police and fire protection,
road maintenance, solid waste collection, zoning, planning, and building
inspection functions.

County residents pay real estate and personal property taxes to the County
for county services and if they live within a town, pay additional property
taxes to their town for town services. Citizens in unincorporated areas are
taxed by the County for fire protection, certain community centers and trash

1% land transfer tax is divided between the County and the towns. | ||
A
6% occupancy tax for hotels, motels and rental properties including online
travel & Airbnb is divided as follows: · 2%
to Dare Co. for beach nourishment and shoreline protection. · 1%
to the Dare Co. Tourism Board. · 3%
divided between county and town governments with 35% of the net amount going
to the towns and 65% going to the county. The proceeds must be used for
“tourism impacted” services. | ||
A
1% prepared food and beverage tax and a 1% occupancy tax for hotels, motels,
and rental properties enables the Dare Co. Tourism Board to promote year round travel and tourism. Of the total, 25% must be

protection is provided throughout the 860+ square miles of Dare Co. by 400
volunteer and career fire fighters in 14 individual fire districts which support
17 fire stations and Hatteras Island Rescue. Each municipality is responsible
for its own fire protection. The Dare Co. Fire Marshal acts as the liaison
between the County Board of Commissioners and its fire districts. The office
is responsible for the enforcement of the NC State Fire Code, assists the
local fire departments in conducting fire investigations and cause and origin
determinations. The office maintains a countywide fire data reporting system,
is active in the area of fire prevention, and designs programs that are geared
toward all citizens. |

Dare
Co. does not have a countywide wastewater treatment system. Manteo and Stumpy
Point have their own wastewater treatment plants. Kill Devil Hills has a
wastewater treatment plant with both commercial and residential customers
that serve part of the Town. There are
several private treatment plants that serve some real estate developments.
Most county residents rely on individual on-site wastewater systems. Permits
for installing new systems and repairing existing systems must be obtained from

Dare County Center is a multi-generational facility that provides resources,
programs and activities for Dare Co. citizens of all ages including arts and
crafts, exercise classes, cooking classes, theater productions, health and

classes, tax assistance, and Medicare assistance. Nutritionally
balanced meals are served five-days a week in a congregate setting or delivered
